Terms and Conditions

These Terms and Conditions ("Terms") govern your use of BurnClock

("the App"), developed and operated by Aman Kumar ("I", "me", "my").

These Terms comply with the Information Technology Act, 2000 and the

Information Technology (Intermediary Guidelines and Digital Media Ethics

Code) Rules, 2021, as applicable.

By downloading or using the App, you agree to these Terms. If you do not

agree, do not use the App.



1. Eligibility


You must be at least 13 years old to use the App. By using the App, you

confirm that you meet this requirement.



2. Not Medical Advice


**The App is a fitness and nutrition tracking tool, not a medical device

or health service.**


  • Body fat percentage figures are model-based projections, not clinical

    • measurements. They are labeled "projected" within the App for this

    reason.

  • Calorie and macro targets are estimates based on established scientific

    • formulas (Mifflin-St Jeor, USDA macro guidelines). Individual results

    vary significantly.

  • AI-assisted meal analysis provides estimates of nutritional content.

    • Accuracy varies, particularly for home-cooked, mixed, and regional dishes.

    Always verify nutritional information for health-critical decisions.

  • Nothing in the App constitutes medical advice, diagnosis, or treatment.

    • Consult a qualified healthcare professional before making significant

    changes to your diet or exercise routine, particularly if you have any

    medical condition.

  • **If you have an eating disorder or a history of disordered eating,

    • please consult a healthcare professional before using calorie-tracking

    features.**

  • The App is not a substitute for professional medical, nutritional, or

    • psychological advice.



    3. Your Account


    You are responsible for maintaining the confidentiality of your account

    credentials and for all activity that occurs under your account. Notify me

    immediately if you suspect unauthorised access.


    You agree to provide accurate information during onboarding. Inaccurate

    inputs (incorrect weight, age, or goal settings) will produce inaccurate

    targets — the App's calculations are only as good as the data you enter.



    4. Subscriptions and Payments


    Free access

    The App may offer limited features without a subscription.


    Paid subscriptions

    Subscriptions are offered on a monthly or annual basis. Prices are

    displayed in Indian Rupees (₹) at the time of purchase and are inclusive

    of applicable taxes.


    Billing and renewal

    Subscriptions renew automatically at the end of each billing period unless

    cancelled. Your payment method is charged at the start of each period.

    Subscription management and cancellation is handled through the Apple App

    Store or Google Play Store — I do not process payments directly.


    Refunds

    Refund requests are handled by Apple or Google according to their

    respective refund policies. I do not issue refunds directly for

    in-app purchases.


    Price changes

    I reserve the right to change subscription prices. You will be notified

    of price changes before they take effect.



    5. User Content and AI Improvement


    When you submit photos or text to BurnClock for meal analysis, you grant

    Aman Kumar a limited, non-exclusive licence to use that content solely to

    provide and improve the App's food analysis features. This includes using

    anonymised and aggregated data to improve the accuracy of food recognition.


    Your health and body data is never used for advertising purposes and is

    never sold to third parties.


    6. Acceptable Use


    You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the App's source code
  • Use the App in a way that could damage, overload, or impair its servers
  • Share your account with others or create accounts on behalf of others
  • Submit false, misleading, or harmful content


    • 7. Intellectual Property


    All content within the App — including the body avatar images, design,

    text, and software — is my property or licensed to me. You may not

    reproduce, distribute, or create derivative works from any App content

    without written permission.



    8. Third-Party Services


    The App integrates with third-party services including Google Gemini,

    Supabase, USDA FoodData Central, Open Food Facts, and RevenueCat. I am

    not responsible for the availability, accuracy, or practices of these

    services. Their terms and privacy policies apply to your use of their

    services within the App.



    9. Disclaimers and Limitation of Liability


    The App is provided "as is" without warranties of any kind, express or

    implied. I do not warrant that:

  • The App will be uninterrupted or error-free
  • Nutrition estimates will be accurate for every food
  • Body composition projections will match your actual physical results

    • **To the maximum extent permitted by applicable law, I am not liable for

    any indirect, incidental, or consequential damages arising from your use

    of the App**, including but not limited to health outcomes resulting from

    following calorie or nutrition targets generated by the App.


    Your use of the App is at your own risk. The App is a tool to support

    your efforts — results depend on your own actions, consistency, and

    individual physiology.



    10. Account Deletion and Data


    You may delete your account at any time from Profile → Account → Delete

    Account. Deletion permanently removes your data from our servers. This

    action cannot be undone.



    11. Changes to These Terms


    I may update these Terms as the App evolves. Continued use of the App

    after changes constitutes acceptance of the updated Terms. The "Last

    updated" date reflects when Terms were last changed.



    12. Governing Law


    These Terms are governed by the laws of India. Any disputes arising from

    these Terms or your use of the App shall be subject to the exclusive

    jurisdiction of the courts of Gurgaon, Haryana, India.
